IL EST PREALABLEMENT EXPOSE CE QUI SUIT
Attendu que conformément à la Décision No. AB 143588 du Comité Populaire de Da Nang en date du 1er février 2005, le Bailleur est le bénéficiaire du droit d’usage d’un terrain de 7.154 m2 (ci-après «DUT ») situé à Phuong Vinh Trung, Thanh Khe District, Da Nang, (ci-après le « Terrain »).
Attendu que conformément à la Décision No. 679/SXD-GDKT le Département de la construction du Comité Populaire de Da Nang a approuvé la construction d'un immeuble commercial par le Bailleur sur le terrain, (1’« Immeuble»).
Attendu que le Preneur, a conclu avec le Bailleur le Contrat en date du 1er mars 2006 aux termes duquel le Bailleur loue au Preneur uoe partie de son Immeuble incluant un supermarché, des espaces annexes (ci-après les «Locaux ») et des espaces de parking,
(ci-après le «Parking ») afin que le Preneur puisse exercer son activité de distributeur.

IT WAS PREVIOUSLY STATED AS FOLLOWS
Whereas in accordance with Decision No. AB 143588 Popular Committee of Da Nang dated 1 February 2005, the Lessor is the beneficiary of the right to use a plot of 7.154 m2 (hereinafter after "DUT") located in Vinh Phuong Trung, Thanh Khe District, Da Nang, (hereinafter the "Land").
Whereas in accordance with Decision No. 679 / SXD-GDKT the Department of Construction of the People's Committee da Nang has approved the construction of a commercial building by the landlord on the ground (1 "building").
Whereas the Lessee, Lessor has signed with the Agreement dated March 1, 2006 under which the lessor leases UOE the Lessee of its building including a supermarket, ancillary spaces (hereinafter the "Premises") and parking spaces
(hereinafter the "Parking") so that the Lessee may exercise its retail activities.
